snapshot_root and backup in the same directory

This is my rsnapshot-test.conf configuration:
--- start config
snapshot_root /foo/backup/
backup /foo/ foo/ exclude=aw
--- end config
# ls /foo/
aw bar lost+found wew
# rsnapshot -c /etc/rsnapshot-test.conf daily
# ls /foo/backup/daily.0/foo/
aw/ bar/ lost+found/ wew/
aw folder still include.
But, when i changed snapshot_root outside the /foo/ it works.
Please help me.
